A Great In-Law Suite Starts With One Question: Was It Permitted?
A Great In-Law Suite Starts With One Question: Was It Permitted?

More and more of the buyers I work with are shopping for two households under one roof: a parent moving down from up north, a college grad coming home, or grandparents who want to be close to the grandkids without being in the same bedroom hallway. An in-law suite in Naples can make that work beautifully, and it can add real value, but only if it was done right. The first question I ask about any converted garage or in-law suite is simple: was it permitted? Here’s why that matters and what else to check.
What counts as an in-law suite
In Naples listings, “in-law suite” can mean a few different things:
- A bedroom wing with its own bath, inside the main house
- A converted garage turned into a bedroom, bath and sitting area, sometimes with a kitchenette
- A separate guest house on its own foundation, more common on acreage. I covered those in my guest house guide
1. Was it permitted?
Turning a garage or an addition into living space is construction, and it generally needs a building permit and inspections under the Florida Building Code. Ask the seller for the permit records and compare the living area on the listing with the parcel record at the Collier County Property Appraiser. If the suite isn’t reflected anywhere, ask why before you write the offer. Unpermitted work can mean an after-the-fact permit, repairs to bring it up to code, trouble with your insurer or lender, and a harder sale later.
2. Is it one home, or two?
A suite with its own kitchen raises a fair question: is the property still one single-family home, or is it being used as two units? On most single-family lots, a suite for family is fine, but renting it out as a separate apartment usually isn’t allowed. If rental income is part of your plan, check the zoning for that specific parcel with the county before you count on it.
3. How does it live day to day?
- Privacy. Does it have its own entrance, or does everyone walk through the kitchen?
- Accessibility. No steps at the entry, a walk-in shower and wide doorways matter a lot for an aging parent.
- Climate. Converted garages often run on a mini-split. Check that it cools the space well in August.
- Parking. Losing the garage means more cars in the driveway. Make sure there’s room.
4. Insurance and taxes
Tell your insurance agent about the suite up front, and send the permit records with your quote request. Added living area can also change the assessed value, so plan for it on the tax bill. My Naples insurance guide covers how to keep the premium in check, and the 4-point inspection guide explains what insurers look at on older homes.

My newest listing in Golden Gate City is a good example of a home set up for family living. It’s a remodeled four-bedroom, four-bath pool home, with a converted garage guest suite that has its own bedroom, bath and kitchenette. Offered at $675,000, here’s what else it has:
- A heated saltwater pool under the screen, with a covered lanai, an outdoor kitchen, a dry bar and a pool bath
- French doors that open the living space right onto the pool deck
- An island kitchen with quartz countertops, wood cabinetry, stainless steel appliances and a wine cooler
- A split bedroom plan, porcelain tile throughout, and baths with tiled showers and frameless glass
- An air-conditioned outbuilding with a mini-split, ready for a home office, gym or hobby room
- A fully fenced 0.23-acre lot with gated side access and room for a boat or RV, a paver driveway, a metal roof, city water and sewer, and no HOA
It’s minutes from Golden Gate Parkway, I-75, shopping and dining, with downtown Naples and the beaches an easy drive away. Weighing Golden Gate City against acreage? Here’s how the two compare.
In-law suites: quick answers
Do I need a permit to convert a garage into an in-law suite in Naples?
Generally yes. Converting a garage to living space is construction that needs a building permit and inspections. Always ask the seller for the permit records.
Can I rent out an in-law suite in Naples?
Usually not as a separate apartment on a single-family lot. A suite for family members is common, but check the zoning for the specific parcel with Collier County before counting on rental income.
Does an in-law suite add value to a Naples home?
A permitted, well-built suite can, because multigenerational buyers actively look for them. An unpermitted one can do the opposite, since buyers and lenders will ask about it.
What should I look for in an in-law suite for an aging parent?
A separate entrance, no steps, a walk-in shower, wide doorways, good air conditioning, and enough parking for everyone.
